Ch 6 - Credit Bureaus & Collection Practices - FA18

  1. Mario and Peach found just the right house. They signed a contract, subject only to being approved for financing. They’re debt free, have good jobs, and have a 20% down payment. When they applied for a 15-year fixed mortgage, they were rejected! The mortgage broker told them that their FICO scores were too low. They were astonished!! When they checked their credit bureau report, they found several glaring inaccuracies. What are the exact steps they need to take with this new information that there are inaccuracies on their credit bureau report?

  1. They first have to place a fraud victims report with their credit bureau. Before their 90 day period is up, they have to get a police report. Their next step is to contact the fraud victim division of each creditor involved. This will help them furnish their documentation. They also need to remember that they owe nothing and should't pay in the mean time. Once their documentation is furnished it will take some time before everything is worked out.

  2. First, they should write a separate letter for each inaccuracy. Then, they should staple a copy of their credit report to each letter. After this, they need to circle the account number. All of these letters should be sent with the certified mail. They should also request to receive return receipts to prove when the credit bureau receives their letters. If the bureau fails to prove the accuracy of the account within thirty days, they should request to remove the entire account from their file.

The letters then need to be mailed. A smart thing to do is to ask for return receipts to ensure the bureau received their letters. The bureau has only 30 days to prove inaccuracies or they must remove the account from the file.

They always have to keep in mind that they're experiencing thief and remember they owe nothing so they need to pay nothing. Once complete with that then they should contact fraud victim divisions of each creditor and furnished documents. Lastly they have to be persistent and remember this will take some time.

If the inaccuracy is not corrected within 30 days, they should request to remove the entire account from their file.

  10. To tidy up their credit report, Mario and Peach will have to first, place a fraud victim alert on their credit bureau report, which will then remain on there for 90 days. Next, they will get a police report, because the theft is more than likely from someone they know. Next, they will continually remind themselves that this is theft, and they owe nothing to no one. After those reminders, they will contact the fraud victim division of each creditor and furnish their documentation. They should continue to be persistent, it's time consuming, but this should be your new hobby.

Afterwords, they must staple a copy of the credit report to each letter to highlight the errors. They also must circle to the account number. Also, they should request to remove the inquiries and send them with certified mail with a return receipt so they can prove it was received. If they don’t take it off within 30 days, they can request to have the entire account removed from their file. After the 30 day period, they can discuss and complaints with the Federal Trade Commission and the state’s Consumer Affairs Division.

They should also include a return receipts, to ensure the bureau received the inaccuracies and they can start to count down of the thirty days, the bureau has to remove inaccuracies.

After placing the fraud victim alert, they will need to then file a police report. A letter of each inaccuracy should be sent to each creditor, with each letter an account number should be present and circled. This being a fraud case means Mario and Peach owe nothing.

  15. One of first things they should do if they want to fix their credit report is write up a letter with all inaccuracies they have found. It is also a great idea to print off a credit report for every inaccuracy. You gotta send each inaccuracy separate with an individual credit with it in a letter. Also if the organization does not fix the error in 30 days you can request to have the entire account taken down.
